General
- Clarity Software (the "Service Provider") hosts various mailing lists (the "Service") both as a service to others and supporting it's own business functions but is is not responsible for the contents, nor does it warrant the accuracy or reliability of any information posted to any lists.
- The Service Provider, to the extent permissible by law, excludes all liability which may arise from your use or reliance on the information or contents contained in messages posted on any lists.
- The Service Provider is committed to protecting your privacy.
- The data collected from you is used solely to provide the service to you.
- You may unsubscribe from any list at anytime.
Postings
In the event that you have posting privileges to a list you agree:
- that you will not post material that contains content which is harmful, threatening, abusive, vulgar, obscene, harassing, defamatory, offensive (racially, sexually or ethnically), promotes a political view or is otherwise objectionable.
- You will not post or transmit chain letters, pyramid or money schemesi
- You will not use an email account to impersonate any person
- You will not use an email account to 'Spam' by posting frequent and/or annoying messages.
- Material that you post must not contain links to 'browser bombs' (sites that open up multiple windows) or to sites that contain material that would fall within the clause above.
- You agree that you will not post content, the display of which would infringe the intellectual property rights of any third party. In particular, you represent and warrant that the content of your posting is original and not copied from any third party.
- You agree that you will not use postings to offer items or services for sale or place advertisements for goods, products or services of third parties unless authorised by the list administrator.
If you breach any of the provisions set out the list administrator may at their discretion terminate your use of the service.
List administrators reserve the right not to circulate any material that you post in their absolute discretion.
Where the list a moderated list you consent to a list administrator viewing your posting prior to distribution.
You consent to a list administrator editing any posting from you for the sole purpose of formatting to make it legible.
Limitations on use
- The postings you read and receive from any list (the 'Content') may be used only for your personal, non-commercial purposes. You agree not to modify, copy, reproduce, retransmit, distribute, sell, publish, broadcast, create derivative works from, or store the content (or any portion thereof) without permissions from the list administrator.
- No link to any part of this website may be made from another website or distributed by email without the prior permission of the Service Provider.
- Disclaimer
- The views and opinions expressed in the content are not those of the Service Provider and no endorsement is made by such of accuracy or completeness of the content. You should not rely on the content.
- When using the services, you may gain access to other websites through use of links or hypertext. You agree that the service provider is not responsible for the content or operation of such third party websites and that the service provider shall have no liability to you or any other person or entity for the use of such third party websites.
- The service provider disclaims all liability to you arising out of your use of the Service , the provision (or lack of) this service and/or the content contained in the service.
Governing law
These terms and conditions of use and your use of the services shall be governed by and construed in accordance with Australian law and the Court of Western Australia shall have exclusive jurisdiction in connection with all matters relating to these terms and conditions of use and the service.
